Often, when people decide to purchase property, they don’t immediately possess the total funds necessary to cover its entire cost. This is where knowledge of real estate finance comes into play.

Rreal estate finance covers a broad range of issues and legal matters, we would like to offer a brief overview of its scope.

There are three types of transactions that constitute the majority of real estate deals:

  • Cash Transactions: Arguably the most simple version of a real estate purchase. Consists of a Seller exchanging the Deed to a property for an agreed-upon sum of money from a Buyer under contract agreements.
  • Third-party Financing:One of the most common forms of real estate transactions. Consists of the Seller tendering the Deed to a property for an agreed-upon sum of money under contract agreements which the Buyer obtains a mortgage loan from a bank or financial institution for the funds required to complete the purchase
  • Seller Financing: Consists of the Seller holding a mortgage on the property being sold which results in the Buyer paying the Seller over time.

Whatever method of sale you decide to utilize in your transaction, speaking with a real estate lawyer is an important first step. Throughout all real estate transactions there are procedures and contracts that require many steps and are made much easier by having the help of an experienced attorney. Additionally, some financing sources in the state of New York will not approve you for a loan if you are not represented by an attorney.

In New York, a loan on real estate is secured by a Mortgage on the real property.

A Mortgage is a legal document that includes two parties: the borrower and the lender. Mortgages create a financial encumbrance on the property the loan is given for. Mortgage foreclosures are handled through the judicial system.
